What can I do if I’m not eligible for Indefinite Leave to Remain after 5 years?

 

Since April 2012 the rules around Tier 2 lengths of stay were changed to set a maximum stay of 6 years on a Tier 2 General Visa. If you are not eligible for ILR after the normal 5 there years then you must wait for 12 months. This is a cooling-off period that you must see out before applying again. Please note that it is slightly different for Tier 2 ICT Visa (5 years max).

 

If I am eligible, how do I go about applying for Indefinite Leave to Remain?

The main issue is whether you have spent more than 90 days outside of the country in any of the 5 years that you have lived in the UK. If you have not exceeded this then you should be OK to apply.     Hi. I am Mr.Gaurang Mulay from India presently working here in UK on Tier 2 General Visa. I am in UK since 28th March 2019 ON Tier2. My current Tier2 Visa expires on 14th Feb 2024 as my Tier2 General ( Skilled Migrant) visa is issued straight for 5 years.I will not be completing 5 years on 14th Feb 2024 as on this date I will be having nearly 45 days short for completing 5 years total stay in UK.My present job is listed on Shortage Occupation List of UK. I would like to know that whether I will be able to extend my Tier 2 visa for one more year if my current employer gives me a new COS for Tier2 Visa so that my Total stay does not exceed 6 years on Tier2 visa. Also once I finish 5 years stay in UK on Tier2 Visa, Can I apply for ILR here in UK.
